Terms of Service

247BrandHQ provides a cloud-based social media management platform that allows businesses, creators, and agencies to schedule, publish, and analyse content on Facebook and Instagram, and manage WhatsApp Business conversations and campaigns. The Service also includes AI-powered tools for content generation, an AI Agent system for automated customer conversation handling, a unified inbox for managing messages and comments across connected accounts, and a leads and outreach module for sales pipeline management. The Service includes our website, web application, mobile apps, and any related APIs or integrations.

You must be at least 18 years old and have legal capacity to enter into a binding agreement to use the Service. If you are registering on behalf of a business, you represent that you have authority to bind that business to these Terms.

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@247brandhq.com if you suspect unauthorised access.

You may not share your login credentials with others. Each user must have their own account. You may invite team members through the workspace invitation feature.

You agree not to use the Service to:

• Publish content that is illegal, defamatory, hateful, or infringes any third-party rights
• Spam, phish, or distribute malware through connected social accounts
• Attempt to gain unauthorised access to our systems or other users' accounts
• Scrape, crawl, or extract data from the Service by automated means
• Circumvent any rate limits, usage quotas, or technical restrictions
• Resell or sublicence access to the Service without our written consent
• Use the Service for any purpose that violates applicable Nigerian law, the laws of the country where you are located, or the terms of service of any connected social platform

Your content — You retain full ownership of all posts, captions, media files, and other content you create or upload to the Service (“Your Content”). By using the Service, you grant us a limited, worldwide, royalty-free licence to store, process, and transmit Your Content solely as necessary to provide the Service.

Our content — The 247BrandHQ platform, including its design, code, trademarks, and branding, is owned by us. Nothing in these Terms transfers any intellectual property rights to you.

Free plan — We offer a free plan with limited features and a monthly post quota. No credit card is required to use the free plan.

Paid plans — Paid plans are billed monthly or annually in your chosen currency (NGN, USD, or other supported currencies). Prices are as published on our pricing page and may change with 30 days' notice.

Renewal — Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

Expiry — If a paid subscription expires and is not renewed within 7 days, your uploaded media files will be deleted. Your account remains accessible but restricted to free plan limits. If the account is inactive for 30 consecutive days thereafter, it may be permanently deleted.

Refunds — We do not offer refunds for partial billing periods. If you believe a charge was made in error, contact us within 14 days at support@247brandhq.com.

When you connect a social network account, you authorise us to act on your behalf to publish, schedule, and retrieve data from that account, subject to that platform's own terms of service and API policies. We are not responsible for changes to third-party platform APIs that affect our Service. You may revoke access at any time from Settings → Social Accounts, or directly through the social platform's app settings.

Our processing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

AI-powered features (caption generation, hashtag suggestions, AI Studio, Autopilot, AI Agents) consume AI credits included in your plan or purchased separately. Credits are non-refundable. AI-generated content is provided as-is. You are responsible for reviewing and approving any AI-generated content before publication. We do not guarantee accuracy, and you should not publish AI-generated content that you have not reviewed.

AI Agents — When you configure an AI Agent with Automatic response mode, the agent may send messages to your customers without manual review, subject to your workspace compliance policy settings and the safety conditions described in the product documentation. You are solely responsible for configuring AI Agents appropriately, including escalation rules, prohibited actions, working hours, and response mode. All messages sent through an AI Agent are sent on your behalf and under your authorised social account credentials. 247BrandHQ is not liable for the content of messages sent automatically by AI Agents you have configured and enabled.

We aim to maintain 99.5% uptime excluding scheduled maintenance. We are not liable for downtime caused by third-party platforms (e.g., Facebook, Instagram) or infrastructure providers. Scheduled maintenance will be announced at least 24 hours in advance where possible.

By you — You may close your account at any time from Settings → Account. Account deletion is processed within 30 days.

By us — We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion with 7 days' notice (or immediately for serious violations). Termination does not entitle you to a refund.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 247BRANDHQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in the courts of Lagos State, Nigeria, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

We may update these Terms from time to time. We will notify you by email and by posting the updated Terms with a revised effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
